Terms of Use
1. Welcome and Acceptance of These Terms
These Terms of Use (the "Terms") set the ground rules for using the websites operated by Fraser Insights ("Fraser Insights", "we", "us" or "our"), including fraserinsights.ca or fraserinsights.com (together, the "Sites"). By visiting or using the Sites, you confirm that you have read these Terms and agree to follow them. If you do not agree, please do not use the Sites.
Our Privacy Policy explains how we handle personal information and forms part of these Terms.
2. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version on the Sites and change the effective date above. Your continued use of the Sites after an update means you accept the revised Terms, so please check back periodically.
3. Information on the Sites Is General in Nature
The Sites describe our market research and consulting services and share our views on research topics. This material is provided for general information only. It is not legal, financial, investment, or other professional advice, and it is not tailored to your circumstances. Please decide for yourself whether any information is suitable for your purposes, and seek qualified advice where appropriate.
We work to keep the Sites accurate and current, but we cannot promise that everything on them is complete, error-free, or up to date. We may change or remove content at any time without notice.
4. Ownership and Permitted Use of Our Content
Everything on the Sites, including text, graphics, logos, images, reports, tools, and the way they are selected and arranged, belongs to Fraser Insights or its licensors and is protected by Canadian and international intellectual property laws. "Fraser Insights" and our logos are our trademarks. You may not use them in a way that suggests endorsement by, or affiliation with, us without our written permission.
You are welcome to view the Sites and to print or download individual pages for your own personal or internal business reference, provided you keep all copyright and ownership notices intact. Beyond that, you may not copy, reproduce, modify, republish, sell, or distribute our content without our prior written consent. We reserve all rights not expressly granted here.
5. Acceptable Use
Please use the Sites lawfully and respectfully. In particular, you agree not to:
use the Sites in any way that breaks applicable law or infringes the rights of others;
attempt to gain unauthorized access to the Sites, our servers, or any connected systems;
introduce viruses, malware, or other harmful code, or interfere with how the Sites operate;
use automated tools such as bots, crawlers, or scrapers to collect content or data from the Sites without our written permission;
use content from the Sites to train, fine-tune, or supply any artificial intelligence or machine learning system without our written permission; or
misrepresent your identity or affiliation when contacting us.
6. Published Research, Reports, and Attribution
From time to time we may publish articles, insights, or research summaries on the Sites. You may quote or reference this material for non-commercial purposes, such as commentary or education, if you clearly credit Fraser Insights, link back to the original page where practicable, and describe the findings accurately and in context.
Please do not alter, selectively excerpt in a misleading way, or present our findings as your own. Any other use, including commercial use or reproduction of full reports, requires our prior written permission. We are not responsible for how third parties interpret or use our published material.
7. Enquiries and Information You Send Us
If you contact us through a form, email, or other feature on the Sites, you agree to provide accurate information and not to send anything unlawful, misleading, or harmful. We will use the personal information you provide as described in our Privacy Policy.
Please do not send us confidential or sensitive information through the Sites unless we have agreed in writing, for example in a signed engagement or confidentiality agreement, to receive it. Sending an enquiry does not create a client relationship or any obligation on our part to provide services.
8. Links to Other Websites
The Sites may link to websites run by others. We include these links for convenience, we do not control those websites, and we are not responsible for their content, privacy practices, or availability. A link does not mean we endorse the site or its owner. If you follow a link, you do so at your own risk and should review that site's own terms and policies.
9. Disclaimers and Limits on Our Liability
The Sites and everything on them are provided "as is" and "as available". To the fullest extent permitted by law, we make no promises or warranties of any kind, express or implied, including about accuracy, reliability, availability, fitness for a particular purpose, or freedom from viruses or other harmful components.
To the fullest extent permitted by law, Fraser Insights and its owners, employees, and contractors will not be liable for any loss or damage, including indirect, incidental, special, or consequential loss, lost profits, or lost data, arising from your use of, or inability to use, the Sites, or from your reliance on their content. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms apply to your use of the Sites only. Research services we provide to clients are governed by separate written agreements.
10. Indemnification
You agree to defend and hold harmless Fraser Insights and its owners, employees, and contractors from any claims, losses, or reasonable costs (including legal fees) that arise from your breach of these Terms or your misuse of the Sites.
11. Suspending or Blocking Access
We may suspend or restrict your access to the Sites at any time, without notice, if we reasonably believe you have breached these Terms or are using the Sites in a way that could harm us, other users, or third parties.
12. Governing Law
These Terms, and any dispute arising from them or from your use of the Sites, are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there. You agree that the courts of Nova Scotia have exclusive jurisdiction over any such dispute.
13. General Provisions
If any part of these Terms is found to be unenforceable, the rest remains in effect. If we do not enforce a provision right away, that does not mean we have given it up. These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the Sites.
